9:10     LITIGATION HOLDS AND PRESERVATION OF ELECTRONICALLY STORED
           INFORMATION
           Preservation of electronically stored information has become a 
           compli-cated, expensive, and time consuming challenge. Beginning with a
           deter-mination of when the duty to preserve arises, continuing to 
           implementing
           and monitoring the hold, preservation can involving immense volumes of 
           electronically stored information in numerous locations. The panel of ex-perts
           will discuss when a litigation hold must be imposed, how to create and monitor
           a litigation hold, and the ethical obligations of attorneys. The panel will discuss
           how to request a litigation hold and how to reduce the risks of spoliation and
           sanctions relating to destruction of evidence while allowing the enterprise to
           operate normally. It will also address the re-sponsibility of counsel in
           implementing and monitoring litigation holds.

           Mistakes in choosing the appropriate format and pinpointing requests in
           electronic discovery can cost the requesting party. Reviewing and analyz-ing
           enormous volumes of electronic documents can be daunting and
           ex-pensive. The panel will discuss how to request production of documents 
           and
           how to use evolving technology and innovative strategies and ap-proaches in
           the review process can streamline review and make it more cost efficient. The
           panel will also address ethical problems relating to the role of counsel and the
           inadvertent production of privileged documents.
